It is illegal for any one but yourself or a licensed attorney or an assistant under an attorneys supervision to prepare or assist you with your divorce or paperwork.
So how are all these other DIY divorce form businesses doing it?
They are likely doing it one of two ways: |
1) they are either ripping you off by selling you a generic fill in the blank packet of forms that you have to fill in and prepare yourself that you could likely have gotten for free or
2) they are using their website to simply transfer your responses to their questionnaire forms with no attorney review or checks for accuracy. Which essentially means:
1) you are doing most of the work that you are supposedly paying them for and
2) you likely won’t even know if the paperwork generated is correct.
So what happens if I make a mistake in my responses or I type an incorrect response?
Since you did it yourself – you are responsible. Your paperwork may be wrong and the results could end up being that in the best case, maybe you can make corrections and re-file or in the worst case, your case gets dismissed, you waste your time and money, don’t get your divorce and have to start over.
How is your Uncontested Divorce Service different?
Our forms are not computer filled in from your responses. Your responses are hand reviewed and our forms are hand drafted and checked for accuracy by a paralegal and are then reviewed by a licensed attorney. We do the filing, we serve your spouse, we put your case on the Court docket and appear in Court for you. In short, once you have signed the simple three page Divorce Complaint that we prepare for you in front of a notary, return it to us and make your payment. Your involvement is done. We handle everything else and send you a certified copy of your divorce judgment.
What about other Divorce Services that advertise $150, $120 or less divorces? Are they really cheaper?
Likely not. This is a ‘teaser fee’ or bait and switch move. We consider it a bit dishonest and misleading and we choose not to do business like that. The $120 or $150 is likely just the legal fee only. You’ll likely have to pay court cost, other fees such as service of process or extra for additional needed services that may put your actual total more than our total flat rate fee of $395 which covers everything needed for a standard uncontested divorce including court cost and service of process fees. We also do not charge an additional fee for simple extra services such as a name change or incorporation of a separation agreement. However, if you are ever quoted a lower total fee than $395 – we will match or beat it if you can provide a copy of the ad or quote. Don’t get suckered by advertisements that don’t include or at least tell you the estimated total cost up front.
